Commercial Lease Renewal

Renewing a commercial lease on the same terms, for tenants or landlords, handled personally and fully online.

Do business tenants have a right to renew their lease?

Many do. The Landlord and Tenant Act 1954 gives many business tenants the right to a new lease when their lease ends, unless the lease was contracted out of the Act.

A lease is contracted out if the right to renew was excluded before the lease was signed, using a set procedure. I can check your lease and tell you whether the right applies.

What happens when a protected lease reaches its end date?

It does not simply end. If the lease is protected by the 1954 Act, the tenancy continues on the same terms after the end date until it is renewed or ended under the Act.

How does the renewal process start?

Usually with a formal notice. The landlord can serve a notice under section 25 of the Act, or the tenant can serve a request for a new lease under section 26.

Either notice must be served between 6 and 12 months before the date it gives for the new lease or the end of the old one. The time limits are strict, and I keep track of them for you.

What if the lease is contracted out?

The tenant has no right to a new lease, but the landlord and tenant can still agree one. I can prepare or review the new lease and complete it.

  4. I check the existing lease and the position under the 1954 Act, then prepare or review the renewal lease.
  5. You sign online, or by post where that is needed, and I complete the renewal.
